The first decision was rendered by the Czech Arbitration Court. We waited impatiently, and especially since it concerns a Benelux trade mark registered under the simplified procedure .
In a case brought by PST BV (in row 2 in the queue) to register EURid, the Dutch company has come to challenge the award decision by EURid domain name
pst.eu another Dutch company, PST Business Solutions BV, a trademark owner "PST", registered in the Benelux.
PST BV The company has come to challenge the validity of the trademark of PST Business Solutions BV on the grounds that the latter has been recorded under an accelerated procedure, it was still subject to opposition proceedings force with the Benelux Trademarks Office (BBM) and besides, society PST BV had itself committed such an opposition procedure.
In his defense, EURid said it had conducted an assessment of strict rules on TLDs.
U.S. recalling that "the mere provision of a copy of an official document of registration from the relevant trademark office is sufficient to justify their rights ". The Czech Arbitration Court, through the panelist Enrique Batalla has confirmed the decision of EURid acceptance of the application sunrise. The complaint is therefore dismissed PST BV, the Court stated, moreover, that the opposition proceedings ended without a decision of rejection of the mark.
